01 Acceptance of terms
Welcome to MYXEON. These Terms & Conditions ("Terms") are a binding agreement between you and MYXEON Studio ("MYXEON", "we", "us") governing your access to and use of our websites, applications, games and related services (the "Services").
By accessing or using the Services, you confirm that you have read, understood and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Services.
02 Eligibility
You must be at least 13 years old (or the minimum digital-consent age in your country) to use the Services. If you are under the age of majority, you may only use the Services with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf.
03 License to use the Services
Subject to these Terms, MYXEON grants you a limited, personal, non-exclusive, non-transferable and revocable license to access and use the Services for your own non-commercial enjoyment. This license does not include any right to:
- Resell, sublicense or commercially exploit the Services.
- Copy, modify, reverse-engineer or create derivative works, except where the law expressly permits.
- Use automated systems (bots, scrapers) in a way that disrupts the Services.
04 Accounts
Some features require an account. You agree to provide accurate information, keep your credentials secure, and accept responsibility for all activity under your account. Notify us immediately at legal@myxeon.com if you suspect unauthorized use. We may suspend or terminate accounts that violate these Terms.
05 Acceptable use
When using the Services, you agree not to:
- Break any law or infringe anyone's rights.
- Cheat, exploit bugs, or use unauthorized third-party software in our games.
- Harass, threaten, or harm other users.
- Upload malware or attempt to gain unauthorized access to our systems.
- Misrepresent your identity or impersonate MYXEON or others.
06 Purchases & virtual items
Some Services offer paid features, subscriptions, or in-game virtual items and currency. All purchases are processed through the relevant app store or payment provider and are subject to their terms. Unless required by law:
- Virtual items are licensed, not sold, have no real-world value and cannot be exchanged for cash.
- Subscriptions renew automatically until cancelled through your store account.
- Refunds are handled by the platform you purchased through, subject to their policies and applicable consumer law.
07 Intellectual property
The Services — including all software, source code, designs, art, audio, characters, text, trademarks and the "MYXEON" name and logo — are owned by MYXEON or its licensors and are protected by intellectual-property laws. Except for the limited license granted above, nothing here transfers any ownership or rights to you.
08 Your content
If the Services let you submit content (usernames, messages, creations), you retain ownership of it. By submitting, you grant MYXEON a worldwide, royalty-free license to host, display and use that content solely to operate and promote the Services. You are responsible for your content and confirm you have the right to share it.
We can remove content that violates these Terms or the law, but we are not obligated to monitor everything users submit.
09 Third-party services
The Services may link to or integrate with third-party platforms (app stores, social logins, analytics, payment providers). We are not responsible for third-party content or practices, and your use of them is governed by their own terms.
10 Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability and non-infringement. We do not guarantee the Services will be uninterrupted, error-free or secure. Some jurisdictions don't allow certain disclaimers, so parts of this section may not apply to you.
11 Limitation of liability
To the maximum extent permitted by law, MYXEON and its team will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits or goodwill, arising from your use of the Services. Our total liability for any claim is limited to the greater of the amount you paid us in the past 12 months or USD 100. This does not exclude liability that cannot be excluded by law.
12 Termination
You may stop using the Services at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue a product. Provisions that by their nature should survive termination (such as intellectual property, disclaimers and liability) will continue to apply.
13 Governing law & changes
These Terms are governed by the laws of the jurisdiction in which MYXEON is established, without regard to conflict-of-law rules. We may update these Terms from time to time; material changes will be signalled by updating the "Last updated" date and, where appropriate, an in-product notice. Continued use after changes means you accept the new Terms.
